Client Terms & Conditions

These Client Terms & Conditions (“Terms”) govern the provision of dog training and related services by Heeli LLC, doing business as Heeli Dog Training (“Heeli,” “we,” “us,” or “our”) to each client (“Client,” “you,” or “your”).
These Terms apply to all Heeli training services and establish the policies, responsibilities, and conditions under which services are provided.
These Terms are provided to the Client following the initial assessment and before the first scheduled training session. By scheduling or proceeding with training services after receiving these Terms, the Client acknowledges that the Client has received and had an opportunity to review these Terms and agrees to be bound by them.
1. Training Services
Heeli provides private, individualized dog training services designed to help dogs and their owners develop practical skills, improve communication and cooperation, and address behavior concerns.
Services may include:

• foundational skills and obedience training;

• puppy training and development;

• behavior modification;

• assistance with anxiety, fear, reactivity, aggression, or other behavior concerns;

• service dog training;

• owner education and coaching;

• environmental and management strategies;

• training plans and exercises for implementation between sessions; and

• other dog training services appropriate to the Client's needs.

The specific services provided will be determined based on the needs of the Client and dog and the training goals established during the assessment.
2. Owner-Centered Training
Heeli uses an owner-centered, science-based approach to dog training.
Training is intended to teach both the dog and the owner. The Client's understanding, participation, and ability to implement training recommendations are important parts of the training process.
Heeli's goal is to give owners practical skills and strategies they can use in everyday life with their dogs.
3. Training Goals and Outcomes
Training goals are established based on the dog's individual needs, the Client's priorities, and information available during the assessment.
Training outcomes may be affected by many factors, including the dog's learning history, genetics, health, environment, behavior, reinforcement history, consistency of training, and the Client's implementation of recommendations.
Heeli does not guarantee that a particular behavior will be eliminated or that a particular outcome will occur within a specific period of time.
Heeli will make reasonable professional efforts to provide appropriate training and guidance toward the agreed training goals.
4. Additional Training When Goals Have Not Been Achieved
If the agreed training goals have not been achieved by the conclusion of the scheduled training program, Heeli will provide up to four (4) additional training sessions at no additional charge, provided that the Client has:

• followed Heeli's training instructions;

• kept and participated in scheduled appointments; and

• practiced the recommended training exercises as directed.

These additional sessions provide additional opportunity to address the agreed training goals. They do not constitute a guarantee that a particular behavior or outcome will ultimately be achieved.
5. Client Responsibilities
The Client understands that successful training depends substantially on what occurs between training sessions.
The Client agrees to:

• provide accurate and complete information about the dog and its behavior;

• follow training and management instructions provided by Heeli;

• practice recommended exercises between sessions;

• implement recommended management strategies;

• attend and actively participate in scheduled sessions;

• communicate promptly regarding significant changes in the dog's behavior, health, environment, or circumstances;

• disclose known or suspected aggression, bite history, significant fear, guarding, or other safety concerns;

• follow veterinary recommendations when medical conditions may affect training or behavior; and

• provide a safe and reasonably appropriate environment for training.

The Client is responsible for implementing training recommendations between sessions and for the dog's behavior outside of training sessions.
6. Training Methods
Heeli uses humane, science-based training methods consistent with its owner-centered training philosophy.
Training strategies may include reinforcement, environmental management, antecedent arrangement, behavior modification, desensitization, counterconditioning, skill development, and other evidence-informed techniques appropriate to the individual dog and training goals.
Training strategies may be adjusted as information is gathered and the dog's response to training becomes clearer.
7. Behavior and Safety Disclosure
The Client must provide complete and accurate information regarding the dog's behavior and history.
This includes, but is not limited to:

• biting or attempted biting;

• snapping;

• aggression toward people or animals;

• resource guarding;

• severe fear or anxiety;

• escape behavior;

• significant reactivity;

• behavior that has resulted in injury;

• behavior that could create a safety concern; and

• known triggers or circumstances associated with unsafe behavior.

Failure to disclose relevant behavior or safety information may require Heeli to modify, suspend, or discontinue services.
8. Behavior Modification
Behavior modification may involve dogs exhibiting fear, anxiety, aggression, reactivity, or other significant behavior concerns.
Behavior modification may require changes to the dog's environment, management procedures, training methods, household routines, and interactions with people or animals.
Heeli may recommend additional professional resources, including veterinary evaluation or consultation with a veterinary behaviorist or other qualified professional.
Heeli may modify or discontinue a training activity if continuing it would create an unreasonable safety concern or would not be appropriate for the dog's current behavioral state.
9. Medical and Veterinary Considerations
The Client is responsible for the dog's veterinary care and for providing Heeli with relevant information about medical conditions, medications, injuries, pain, mobility limitations, or other health factors that may affect training or behavior.
The Client agrees to inform Heeli of significant changes in the dog's health or medication.
Because pain and medical conditions can affect behavior and learning, Heeli may recommend veterinary evaluation when appropriate.
Heeli is not a substitute for a veterinarian or veterinary behaviorist.
10. Service Dog Training
Where service dog training is provided, Heeli's role is to provide training and education relating to the dog's behavior, skills, and task training.
Heeli does not guarantee that a dog will ultimately qualify as a service dog, meet the requirements of a particular organization, or be appropriate for a particular individual's needs.
The Client is responsible for complying with applicable laws, regulations, and other requirements governing service animals.
11. In-Home Training Environment
Because Heeli provides private, in-home training, the Client is responsible for maintaining a reasonably safe training environment.
The Client should identify potential hazards before the trainer arrives, including unsecured animals, dangerous objects, unsafe areas, or other conditions that could interfere with training.
Heeli may request that other animals, household members, or visitors be separated from the training area when appropriate.
The trainer may modify the location or activities of a session when necessary for safety or effective training.
12. Children and Other Household Members
The Client is responsible for supervising children and other household members during training sessions.
Heeli may provide instruction regarding safe and appropriate interactions between children, household members, and the dog.
Children should not be left unsupervised with a dog when the dog's behavior presents a potential safety concern.
13. Other Animals
The Client must disclose the presence of other animals in the household or training environment and any known behavior concerns involving those animals.
Heeli may determine that other animals should be separated, restrained, or otherwise managed during portions of a training session.
14. Trainer Safety and Right to Modify or End a Session
Heeli's trainers may modify, pause, relocate, or end a training session when necessary to protect the safety of the trainer, Client, household members, animals, or other persons.
Circumstances may include:

• undisclosed aggression or safety concerns;

• uncontrolled or unsafe animals;

• environmental hazards;

• threatening or unsafe conduct;

• a dog's behavioral or emotional state making the planned activity inappropriate; or

• circumstances outside the trainer's reasonable control.

When reasonably possible, Heeli will discuss the circumstances with the Client and identify an appropriate next step.
15. Scheduling and Attendance
Training sessions are scheduled by mutual agreement between Heeli and the Client.
The Client is responsible for attending scheduled appointments and being prepared to participate at the scheduled time.
If the Client needs to reschedule an appointment, the Client should provide as much notice as reasonably possible.
Heeli may establish reasonable scheduling and cancellation procedures and may charge applicable fees for appointments that are missed or cancelled with insufficient notice, as communicated to the Client.
Failure to attend or participate in scheduled training sessions may affect progress and may affect eligibility for additional training sessions under these Terms.
16. Unused Sessions, Extended Breaks, and Rehoming
Unused training sessions do not expire.
If six (6) months or more have elapsed since the Client's most recent training session, Heeli will conduct a new assessment before training resumes.
The Client will be responsible for the applicable assessment fee.
The new assessment does not eliminate or reduce unused sessions.
The purpose of the reassessment is to determine whether changes in the dog's behavior, health, environment, training history, household circumstances, or other factors require modification of the training approach.
Rehoming or Transfer of Ownership
If a dog is rehomed or ownership of the dog is transferred to another person, unused training sessions may follow the dog to its new home.
Training may continue with the new owner provided that:

• the new owner agrees to assume responsibility for the remaining training program;

• the new owner receives and agrees to Heeli's then-current Client Terms & Conditions; and

• Heeli determines that continuing the existing training plan is appropriate based on the dog's current circumstances and needs.

The new owner must complete any enrollment or service documentation required by Heeli before training resumes.
A change in ownership does not convert unused sessions into a cash refund or otherwise alter the nonrefundable nature of the purchased program.
Heeli may require a new assessment before continuing training with the new owner when circumstances warrant, including when the dog's environment, behavior, health, training history, or training goals have materially changed.
17. Program Fees and Payment
The Client agrees to pay the applicable fee for the training program according to the payment arrangement established at the time of purchase.
Training programs are purchased as complete programs rather than as individual sessions.
A payment plan, when offered, is a method of paying for the program and does not change the nature of the purchase.
18. Refund Policy
All Heeli training programs are nonrefundable once purchased.
The Client's purchase is for the training program as a whole rather than for individual sessions.
The Client is not entitled to a refund based on unused sessions, a change in circumstances, a change in the dog's behavior, the Client's decision to discontinue training, or dissatisfaction with training results, except where a refund is required by applicable law or expressly agreed to by Heeli in writing.
The nonrefundable nature of the program does not eliminate the Client's right to receive unused sessions under these Terms.
Unused sessions do not expire, subject to the reassessment requirement described in Section 16.
19. Discontinuation or Termination of Services
The Client may choose to discontinue training services at any time.
If the Client chooses to discontinue training, the program remains nonrefundable and unused sessions remain available subject to these Terms.
Heeli may suspend or terminate services when reasonably necessary because of:

• safety concerns;

• material nondisclosure or misrepresentation regarding the dog's behavior or history;

• repeated failure to follow essential training or safety instructions;

• inappropriate, abusive, or threatening conduct toward a trainer;

• failure to make required payments; or

• circumstances that make continued services inappropriate or impracticable.

Termination by Heeli does not automatically create a right to a refund.
20. Communication
The Client is responsible for maintaining accurate contact information and for reviewing communications from Heeli relating to scheduling, training, payment, and services.
The Client should promptly communicate information that may materially affect the dog's training or the safety of a training session.
21. Photographs, Video, and Training Records
Heeli may maintain records relating to the Client's training, including assessment information, training notes, recommendations, and progress information.
Heeli will not use photographs or videos of the Client or the Client's dog for public marketing purposes without appropriate authorization.
Training records may be retained as reasonably necessary for business, training, administrative, legal, or safety purposes.
22. Privacy and Confidentiality
Heeli will make reasonable efforts to protect the privacy of Client information.
Information concerning a Client or dog may be shared when reasonably necessary to provide services, coordinate care or referrals, address safety concerns, comply with legal requirements, or protect the rights and safety of Heeli, its personnel, clients, or others.
23. Assumption of Risk
The Client understands that working with animals involves inherent risks.
Dogs may behave unpredictably, and training cannot eliminate every possibility of injury, property damage, escape, or other incident.
The Client assumes responsibility for reasonably foreseeable risks associated with handling, interacting with, training, transporting, and managing the dog, including risks arising from the dog's behavior.
The Client remains responsible for supervising and controlling the dog outside of the trainer's direct control.
24. Protection of Heeli LLC and Elizabeth Givens
For purposes of these Terms, the term “Protected Parties” includes:

• Heeli LLC, doing business as Heeli Dog Training;

• Elizabeth Givens, individually;

• Heeli's owners, officers, employees, trainers, contractors, and authorized representatives; and

• other persons acting on behalf of Heeli in providing services.

To the fullest extent permitted by applicable law, the Client agrees that claims arising from the Client's participation in training services will be subject to the limitations, responsibilities, and risk allocations established by these Terms.
Nothing in these Terms is intended to waive or limit any right or remedy that cannot legally be waived or limited under applicable law.
25. Limitation of Liability
To the fullest extent permitted by applicable law, Heeli and the Protected Parties will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the provision of training services.
The Client understands that Heeli cannot guarantee the behavior of a dog or prevent every incident involving the dog.
The Client remains responsible for the dog and for taking reasonable precautions appropriate to the dog's behavior and circumstances.
Nothing in these Terms is intended to exclude or limit liability to the extent such exclusion or limitation is prohibited by applicable law.
26. Client Responsibility for the Dog
The Client retains ownership, possession, and responsibility for the dog at all times unless a separate written agreement expressly provides otherwise.
The provision of training services does not transfer ownership, custody, or legal responsibility for the dog to Heeli.
The Client is responsible for complying with applicable licensing, vaccination, identification, leash, animal-control, and other legal requirements relating to the dog.
27. Referrals and Scope of Practice
Heeli may recommend consultation with another professional when a dog's needs fall outside the appropriate scope of dog training services.
Such referrals may include veterinarians, veterinary behaviorists, qualified behavior professionals, groomers, pet care providers, or other professionals.
A referral does not constitute a guarantee or endorsement of another professional's services.
28. No Veterinary, Medical, or Legal Advice
Heeli provides dog training and behavior services and does not provide veterinary, medical, psychological, or legal advice.
Training recommendations should not be understood as a diagnosis or treatment of a medical or veterinary condition.
The Client should consult an appropriately licensed professional for veterinary, medical, legal, or other professional advice outside the scope of Heeli's services.
29. Material Breach
A material violation of these Terms may result in suspension or termination of services.
Examples may include failure to disclose significant safety information, repeated failure to follow essential safety instructions, abusive or threatening conduct toward a trainer, or failure to make required payments.
Where appropriate, Heeli may provide the Client with an opportunity to correct the issue before terminating services.
30. Governing Law
These Terms and the relationship between the Client and Heeli will be governed by the laws of the State of New Mexico, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise.
31. Severability
If any provision of these Terms is determined to be invalid, unenforceable, or contrary to applicable law, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will remain in effect.
32. Entire Agreement
These Terms, together with any written agreement describing the specific services purchased, constitute the agreement between the Client and Heeli concerning the provision of training services.
33. Amendments and Changes
Heeli may update these Terms from time to time for future services.
The Terms applicable to a Client's purchased program are the Terms provided to the Client in connection with that program, unless the Client and Heeli subsequently agree in writing to a modification.
34. Electronic Acceptance
By scheduling or proceeding with training services after receiving these Terms, the Client acknowledges that the Client has received and had an opportunity to review these Terms and agrees to be bound by them.
Electronic acceptance, signature, or other electronic acknowledgment may be used to document the Client's agreement to these Terms.
